Pesticide application records in New Jersey

What N.J.A.C. 7:30-6.8 asks for on each structural pest control record, how long to keep it and what the customer must get, based on our reading of the rule. And how PestSheet covers it.

What the record must include

  • Date of application; if the label sets a restricted-entry interval (REI), the hour completed and the re-entry date and time
  • Place of application: specific address, municipality and county
  • Site of application
  • Brand name, active ingredients and EPA registration number of each pesticide
  • Mixing recipe: total amount of concentrate and total amount of diluent
  • Total amount of pesticide mixture used in the application
  • Size of the area treated, when the label gives a rate per area
  • Full name and license number of the applicator (and full name of any handler)

How long to keep it

3 years. Termiticide application records: 5 years. Records must be written within 24 hours of the application. Signed notice waivers: 3 years.

What the customer gets

  • Before any household or structural application, the residents (single-family), the contracting party, tenants or residents (multifamily) or the contracting party and building manager (commercial/institutional) must receive a written or emailed consumer information notice.
  • The notice must list the pesticides (brand and active ingredient), label safety precautions, the company's name, address and phone, the National Pesticide Information Center and NJ Poison Information and Education System numbers, and state that exact dates and label copies are available on request.
  • It must include the Pesticide Control Program phone with the fixed sentence "This number is for pesticide regulation information and pesticide complaints" and the fixed sanitation paragraph beginning "Sanitation, as well as physical and biological control measures...".
  • Single-family and multifamily customers may sign (or confirm by email) a waiver with fixed wording; commercial buildings have no waiver.
  • In multifamily housing, a decal (at least 15 sq in, legible from 3 feet) with fixed text goes inside a kitchen cabinet door of each unit before treatment.
  • A copy of the application record must be given to the customer on written request.

Termites, fumigation and other cases

  • Termiticide records must also include a diagram of the treated structure (lower level, infestation and damage, areas treated, wells, drains, nearby water).
  • Aerosol or fog applications in attached structures require notifying adjacent occupants (crack-and-crevice and flushing agents excepted).
  • Commercial and institutional buildings need a posted notice of the last and next application; malls, stores and airports need "Pesticide Treated Area" signs during application.

The client's name and address, the service date and start time, and the applicator's name are always recorded. The app uses the N.J.A.C. 7:30-6.8 template. It doesn't check items the app doesn't record (for example active ingredients or equipment); those remain your responsibility.

What we could not confirm

  • We could not confirm against NJDEP's official copy that the text of N.J.A.C. 7:30-9.12 was unchanged by the 2022 readoption of Chapter 7:30.
  • We could not confirm the Pesticide Control Program phone number against NJDEP's official page.
